Analysis on Dialectical Relationship Between "Legal" and "Logic" in the Teaching of Legal Logic in Judicial Colleges

Abstract


Legal logic has not been given rightful position and attention in the course system in colleges and universities. This situation has become a normal situation since the establishment of legal logic in China. However, judicial colleges and universities are not the same with the normal ones. The author believes that law and logic are twins at the beginning of the development of the discipline: without logic and law learning, the cognition will be on the basis of one-sided viewpoint, which is easy to get lost and hard to achieve the success. The main task of judicial colleges and universities is to train and cultivate legal talents. However, due to the unreasonable setting of legal logic class, too much attention to the basic principles and even vacancy in the course setting for some law related majors, teachers of current legal logic are facing the difficulties. For this reason, the author puts forward some teaching comments for attention.
